1. Introduction

Welcome to Dezyn, operated by dezyn.io LLC (hereinafter referred to as "dezyn.io LLC", "we", "us", or "our"). By accessing or using the platform, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the platform.

2. Definitions

  • "User" refers to any individual or entity who accesses or uses the Dezyn platform.
  • "Subscription Service" refers to the paid monthly subscription plan that provides access to additional features and services of Dezyn.
  • "Content" refers to all components, diagrams, images, text, and other materials created or uploaded by the User within the platform.

3. Use of the Platform

  • Dezyn is intended for creating flow charts, architecture diagrams, and interactive design documents.
  • Users must provide accurate and complete information when creating an account.
  • Users are responsible for maintaining the confidentiality of their account login information.

4. Subscription and Payment

  • Dezyn offers a Subscription Service that requires a monthly fee.
  • Subscription fees are billed on a monthly basis and are non-refundable.
  • Users may upgrade or downgrade their subscription plan, with changes taking effect at the start of the next billing cycle.
  • dezyn.io LLC reserves the right to change subscription fees upon 30 days' notice to the User.

5. User Content

  • Users retain ownership of the Content they create within the platform.
  • Users grant dezyn.io LLC a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute the Content for the purpose of operating and improving the platform.
  • Users are prohibited from uploading Content that is unlawful, harmful, or infringes on the rights of others.

6. Intellectual Property

  • All intellectual property rights in Dezyn, including software, design, and features, are owned by dezyn.io LLC or its licensors.
  • Users are granted a limited, non-transferable license to use the platform for personal or business purposes in accordance with these Terms and Conditions.

7. Prohibited Conduct

  • Users must not misuse the platform by attempting to gain unauthorized access to its services or systems.
  • Users must not use the platform to create, upload, or distribute Content that is offensive, defamatory, or violates any laws or regulations.
  • Users must not use the platform for any activity that may harm or disrupt its operation or interfere with other users' access to the platform.

8. Termination

  • dezyn.io LLC reserves the right to suspend or terminate a User's account at any time if the User violates these Terms and Conditions.
  • Users may cancel their subscription at any time, with the cancellation taking effect at the end of the current billing period.
  • Upon termination, all licenses granted to the User will immediately cease.

9. Limitation of Liability

  • The platform is provided on an "as-is" and "as-available" basis. dezyn.io LLC makes no warranties or representations regarding its reliability, accuracy, or fitness for a particular purpose.
  • To the maximum extent permitted by law, dezyn.io LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the platform.

10. Changes to Terms and Conditions

  • dezyn.io LLC reserves the right to modify these Terms and Conditions at any time. Users will be notified of any changes through the platform or via email.
  • Continued use of the platform after any changes to the Terms and Conditions constitutes acceptance of the revised terms.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms and Conditions shall be resolved in the state or federal courts located in California.
